This Membership Agreement (“Membership Agreement”) is concluded between LUFIAN PAZARLAMA HİZMETLERİ ANONİM ŞİRKETİ, located at Mahmutbey Mah. Dilmenler Cad. No: 19 İç Kapı No: 31, Bağcılar/Istanbul, and the MEMBER who registers on the website, for the purpose of determining the terms and conditions regarding the services provided by LUFIAN on the website and the rights and obligations of the parties accordingly.
The MEMBER declares and undertakes that they have read the entire Membership Agreement, fully understood its content, and approved all its provisions.
Website or Internet Website:
The domain website www.lufian.com operated by LUFIAN, through which various services and content are provided within the framework determined by LUFIAN.
Member:
Any real person approved by LUFIAN after fully completing the membership form for the purpose of purchasing products from LUFIAN. Individuals over the age of 18 may become members by filling out the relevant membership form completely using their real identity information.
User:
A person visiting the LUFIAN website with or without making purchases.
Link:
A connection enabling access from the WEBSITE to another website, files, content, or from another website to the WEBSITE, files, and content.
Content:

Personal data shared by the MEMBER for creating a membership or benefiting from the website are collected, stored, and processed by LUFIAN or its business partners in accordance with the Privacy and Data Security Policy, Personal Data Protection Clarification Text, and Cookie Policy for purposes such as performance of obligations under the Membership Agreement, operation of the website, provision of advantages to the MEMBER, execution of payment processes, delivery of orders, customer service and complaint management, and personalized advertising, marketing, surveys, profiling, and statistical studies.
In accordance with applicable legislation, LUFIAN may share the MEMBER’s information with competent authorities where necessary under the Personal Data Protection Law No. 6698, subject to data transfer rules and, where required, after informing the MEMBER in advance.
The MEMBER cannot hold LUFIAN liable if personal data and information obtained during membership and/or shopping must be disclosed due to legal obligations. LUFIAN declares that it shall process personal data lawfully within the framework of its obligations under Law No. 6698 and take sufficient technical and administrative measures to prevent unlawful processing, access, and disclosure.
The MEMBER understands that they may always review the Privacy and Personal Data Protection Policy on the website for more information regarding the use of personal data and related rights and may contact kvkk@lufian.com or use other methods specified in the Application Form on the website.
The MEMBER declares that all information provided in this form and later submitted is accurate and shall be updated immediately in case of changes. The MEMBER accepts responsibility for any damages suffered by LUFIAN due to inaccurate information.
The MEMBER agrees to act in compliance with this Membership Agreement, all conditions specified on the website, applicable laws, and moral rules during transactions and correspondence on the website. Legal and criminal liability arising from actions performed on the website belongs to the MEMBER.
A member may only have one registration.
LUFIAN may terminate the Membership Agreement at any time without providing any justification.
The MEMBER may terminate this agreement and membership by contacting the call center at 0 850 811 85 36, sending an e-mail through the contact form, or notifying through the website.
Upon termination of membership for any reason, all rights granted to the MEMBER shall expire.
LUFIAN may unilaterally amend this Membership Agreement and all policies, terms, and conditions on the website, including the Cookie Policy, Clarification Text under the Personal Data Protection Law, and Data Processing Policy, at any time provided that such amendments do not violate applicable legislation.
The MEMBER accepts that LUFIAN’s official books and commercial records, database records, server records, e-archive records, electronic information, electronic correspondence, and computer records shall constitute binding, conclusive, and exclusive evidence in disputes arising from this Membership Agreement.
This Membership Agreement shall be governed exclusively by the laws of the Republic of Türkiye. Any disputes arising out of or related to this Membership Agreement shall fall under the exclusive jurisdiction of the Istanbul Büyükçekmece Courts and Enforcement Offices.
LUFIAN may communicate with the MEMBER through the email address provided during registration or by calling or sending SMS messages to the phone number provided. The MEMBER is obliged to keep their email address and phone number up to date.
If any provision of this Membership Agreement is deemed invalid or unenforceable, the remaining provisions shall remain fully valid and enforceable.
The MEMBER may not assign any rights or obligations under this Membership Agreement without LUFIAN’s prior written consent.
Failure or delay by either Party in exercising any right granted under this Membership Agreement shall not constitute a waiver of such right.
The website may contain links to third-party websites outside LUFIAN’s control. LUFIAN bears no responsibility for the content of linked websites or damages arising from their use.
LUFIAN continuously checks the accuracy and timeliness of information on the website. However, no explicit or implied warranty is provided regarding the accuracy, completeness, or suitability of the information and services available on the website.
LUFIAN shall not be liable for any direct or indirect damages arising from access to or use of the website, including interruptions, errors, omissions, or other issues.
